Three separate things govern a WhatsApp message to a German number: who regulates the network, what the law says about consent, and what the data protection regime requires of the record you keep.
The Bundesnetzagentur supervises and regulates Germany's telecoms, energy, postal and rail markets, and it fines unlawful advertising calls up to 300,000 euros. Data protection for an ordinary business is not federal at all: the Federal Commissioner (BfDI) covers federal bodies and telecoms and postal providers, while most private companies answer to the data protection authority of their own Land.
